About the Event

Prof. Dr. Shobalatha Udapudi, Visiting Professor (Law), Tamil Nadu National Law University, Tiruchirappalli welcomed the gathering. The event was witnessed by nearly 75 participants.  Mr. A. Nirmal Singh Heera, Assistant Professor (Law), Tamil Nadu National Law University, Tiruchirappalli introduced the resource person Mr. R. Venkatesan (I.P.R.). Senior Examiner of Trademarks and G.I. who had readily accepted to deliver the talk on “Intellectual Property Rights”.

After the formal introduction of the resource person, the session was handed over to Mr. R. Venkatesan. He started his lecture by giving a general introduction about the location of the IP offices in India. Also, he gave a general introduction about the various intellectual property rights available, such as patent, designs, Trademarks, GI, Copyright, Semi-Conductor Integrated Circuit Layout design, Protection of Plant Varieties and Farmers Rights and the Trade Secret. He spoke about the different intellectual properties in a single product by quoting several examples, such as LED Display relatinges to patent, Body of Laptop – Design; Apple sign – Trademark, User manual – Copyright and the Layout of IC – SICL Design.

Next, the resource person highlighted the patent and the inventions invented by the scientist in the olden days such as Thomas Alva Edition – Phonograph; Alexander Graham Bell – Television; Wright Brothers – Airplane; Louis Pasteurure – Rabies Vaccination and Alexander Fleming – Penicillin. In addition to the above, he cited various other examples including famous Indian innovations to clearly understand the concepts of the patent. Further, he emphasized on the Design rights using a few examples. Also, he spoke about designs set of articles.  As his lecture was with the objective to create awareness, the audience, the resource person discussed the importance of copyright by using various illustrations. Next he went on to discuss about the SICLDR. Further, he discussed Trade secrets using images for better understanding of the concepts.

He then explained Trademarks, its meaning, concepts and, functions. He highlighted various examples of trade marks. Further, the resource person highlighted the subject matter of the trade mark, such as trade mark, service mark, certification of marks, collective marks, Tagline and, slogans. Then, he highlighted some of the non-conventional trademarks, such as the olfactory ones like, smell, scents, 3D, shapes, sound Aural, Moving marks etc. further he discussed about the deceptively similar marks. During his talk about the filing of application for trademark registration. He discussed as to how to indicate the trademark, renewal and post registration management.

Geographical Indication and its nature was also highlighted during the lecture. He said that under the Indian GI Act, goods are divided mainly into 3 categories, agricultural, natural and manufactured. Several examples of the goods were also shown during the lecture. Persons eligible for the application for the GI was also discussed and lastly, the tenure of the protection of various intellectual property rights was highlighted.

Subsequently, the floor was open for question and answers. The event came to an end around 5.30 pm with a formal vote of thanks by Mr. Aravind A.S, IV B.Com., LL.B (Hons.), student of TNNLU, Tiruchirappalli.
